We have had a survey done. If we put the fence up one inch over our side will that be enough? We have asked the neighbor next door if they want to contribute and they do not., Do we have to have a permit to do put up a fence?

Hi, there
Since you already have a survey, we can install the fence safely within your property line. We typically set it 1–2 inches inside your boundary, which is standard and avoids any future issues.
In Toronto, no permit is required for most residential fences, as long as they follow these limits:
• Backyard: up to 2.0 m (6.5 ft)
• Front yard: up to 1.2 m (4 ft)
You can move forward without your neighbor’s approval if the fence is fully on your side.

I am no expert on this but I googled it and this is what internet came up with.( If your neighbor does not want to contribute to the cost of a new fence, the best place to install it is entirely on your own property, usually a few inches (e.g., 2 to 6 inches) away from the property line. Installing it on your side allows you to avoid needing their permission for the design or construction, but it means you bear 100% of the cost and maintenance )

You cannot technically build anything on someone elses property without their consent. It is a shame as they will certainly benefit from the fence, but you cannot construct it halfway on their property without consent.
